MY LOVED ONE DIED RESCUING A DROWNING PERSON. CAN WE SUE THE PERSON WHO WAS RESCUED ?.

By BarefootLawyers.   Right as Lwanga got out of the taxi at his home stage, he saw Ambrose struggling and drowning in Nakivubo channel. Being an expert fisherman, he dived in and tried to rescue him.   While Lwanga was dragging Ambrose to safety, Ambrose swung his arms and hit Lwanga against a stone. Bystanders pulled Ambrose out, but Lwanga drowned because he was unconscious from the injury to his head.   Lwanga’s family want to sue Ambrose for killing their son. Can they do this?     WHAT DOES THE LAW SAY?   The law says that when a person willingly engages in an activity that is risky or dangerous while fully knowing what the most likely outcome of such action will be, then you are taken to do this at your own risk.   This is called “Voluntary Assumption of risk”. This principle says that if you knowingly and voluntarily expose yourself to a risk, you cannot sue someone if you are injured as a result.   As long as no one has forced you to do something risky, then you ca

WORLD DAY AGAINST TRAFFICKING IN PERSONS.

By BarefootLawyers.   Yesterday Sunday 30-7-2023 was the World Day Against Trafficking in Persons. Trafficking in persons is a serious crime which violates the human rights of every person. Every year, thousands of men, women and children fall into the hands of traffickers in their own countries and abroad.   Human trafficking is a crime where people are tricked or forced into doing things, they don't want to do such as working without pay, being forced into prostitution, slavery, working against your will (involuntary servitude), etc. This is done when someone is forced or tricked into being moved from one place to another or held against their will using threats, lies, or taking advantage of their helplessness.  For example if a Kafumisi a boda man meets a Makku who is just has just come off a bus in Kampala from her village for the first time and instead of giving her directions ‘tricks’ her into going to his house or a lodge for the night to have sex with her to pay

Apple Sets New Rules for Developers to Prevent Fingerprinting and Data Misuse.

By THN. Apple has announced plans to require developers to submit reasons to use certain APIs in their apps starting later this year with the release of iOS 17, iPadOS 17, macOS Sonoma, tvOS 17, and watchOS 10 to prevent their abuse for data collection. "This will help ensure that apps only use these APIs for their intended purpose," the company said in a statement. "As part of this process, you'll need to select one or more approved reasons that accurately reflect how your app uses the API, and your app can only use the API for the reasons you've selected." The APIs that require reasons for use relate to the following - File timestamp APIs System boot time APIs Disk space APIs Active keyboard APIs, and User defaults APIs The iPhone maker said it's making the move to ensure that such APIs are not abused by app developers to collect device signals to carry out fingerprinting , which could be employed to uniquely identify users across

macOS Under Attack: Examining the Growing Threat and User Perspectives.

By THN. As the number of people using macOS keeps going up, so does the desire of hackers to take advantage of flaws in Apple's operating system. What Are the Rising Threats to macOS? # There is a common misconception among macOS fans that Apple devices are immune to hacking and malware infection. However, users have been facing more and more dangers recently. Inventive attackers are specifically targeting Mac systems, as seen with the "Geacon" Cobalt Strike tool attack. This tool enables them to perform malicious actions such as data theft, privilege elevation, and remote device control, placing the security and privacy of Mac users at grave risk. Earlier this year, researchers also uncovered the MacStealer malware, which also stole sensitive data from Apple users. Documents, iCloud keychain data, browser cookies, credit card credentials – nothing is safe from the prying eyes. But that's not all. CloudMensis is malicious software that specifically t

MPs launch forum to curb illicit financial flows and tax injustice.

Ugandan MPs led by Maracha County MP, Hon. Oguzu Lee Denis have launched Ugandan Chapter of the African Parliamentary Network on Illicit Financial Flows and Tax Justice ( APNIFFT) as a platform to mobilize fellow MPs, exchange information and build capacities to tackle the challenge of IFFs and perennially inadequate domestic resources. Oguzu in his opening remarks noted that Uganda's Tax to GDP ratio continues to be below Africa's average of 17% at paltry 14% and the ever narrowing fiscal space continues to pile pressure on government to borrow yet the problem could be solved by curbing illicit financial flows that have continued to undermine domestic resource mobilization efforts. According to SEATINI, $10 per person is lost in Uganda to IFFs annually. These largely take the form of commercial activities (65%), crime 30% and corruption 5%. The chapter formation is a culmination of efforts by African Union High Level Panel on IFFs.  Illicit

WARNING SIGNS OF UNSAFE BRAKE.

By SJAFE01. 1. Your Brake Light Is On One of the easiest indications that your brakes are in need of help is when your brake warning light appears on your dash. In fact, most modern vehicles have two warning lights that can appear on the dash for various reasons. If you have a brake light on the two options are your Antilock Braking System (ABS) or the brake system warning light. If you see an ABS warning light on your dash, you need to take your vehicle to a local dealer or repair shop, as they're equipped with the right equipment.  Your brake light won't always come on when there is an issue — it's also the light that appears on your dash when your parking brake is engaged. But if you're seeing a brake warning light and your parking brake isn't engaged, it's time to have a brake specialist take a look and diagnose your ABS System issues.

CAN I CHANGE MY MIND ABOUT THE INHERITANCE I RECEIVED AND ASK FOR SOMETHING ELSE ?.

By BarefootLawyers. Okello lost his wife 20 years ago and decided to only focus on their Mateo, Yona and Yosefu. 20 years later, Okello had 7 acres of land, a successful poultry business, and sinotrucks for hire. Early this year, Okello got a call telling him that one of his trucks knocked a boda boda. Okello decided to rush to see if he could sort it out before police became involved. Unfortunately, he never made it, as he was entering the main road, another trailer rammed into him and killed him instantly.   After Okello had been laid to rest, his sons sat down and divided the property amongst themselves. However, of late, Yosefu the last born has started complaining that he was cheated, and he wants to be given something else because most of the chicken in the chicken business died of a fever.   Can Yosefu cancel the distribution and demand for something else?     WHAT DOES THE LAW SAY? Once a person dies, their property does not automatically stop being theirs. Instead,

Apple Rolls Out Urgent Patches for Zero-Day Flaws Impacting iPhones, iPads and Macs.

By THN. Apple has rolled out security updates to iOS, iPadOS, macOS, tvOS, watchOS, and Safari to address several security vulnerabilities, including one actively exploited zero-day bug in the wild. Tracked as CVE-2023-38606 , the shortcoming resides in the kernel and permits a malicious app to modify sensitive kernel state potentially. The company said it was addressed with improved state management. "Apple is aware of a report that this issue may have been actively exploited against versions of iOS released before iOS 15.7.1," the tech giant noted in its advisory. It's worth noting that CVE-2023-38606 is the third security vulnerability discovered in connection with Operation Triangulation , a sophisticated mobile cyber espionage campaign targeting iOS devices since 2019 using a zero-click exploit chain. The other two zero-days, CVE-2023-32434 and CVE-2023-32435 , were patched by Apple last month. Kaspersky researchers Valentin Pashkov, Mikhail Vinogrado

How to Avoid Windshield Damage While Traveling.

Well, you cannot avoid all car windscreen problems and can go for windscreen replacement. Rather, you must try to avoid this emergency as soon as you get to know about it from afar. So, let's discuss those simple tips and tricks to protect car windshields while on the road.  Steps to Avoid Windscreen Damage on the Road 🚨 Drive Within The Limit And Carefully Most windshield cracks and damage happen when the driver is driving at high speed and any foreign objects come and hit the car windshield. In this case, the flying debris hit the shield with much greater force, which caused cracks to appear on the car windscreen. Moreover, the weather condition of that area also plays an essential role in damaging the windshield. Likewise, when wind and water are in the air, they carry objects that can damage the screen. So, for best results, try to drive slowly within the speed limit; otherwise, you will have to opt for windscreen replacement, which is an expensive option.  ⚠️ Be C

DO I NEED A COURT ORDER TO DO A DNA TEST ?.

By BarefootLawyers. No! if you are a parent or a child and there is no disagreement or refusal by one of the people involved or should be tested, you can voluntarily take a DNA test to find out if ‘those’ parents or children are really yours.   However, if one person denies or refuses responsibility, you cannot force them to just ‘do a test’. You must apply to the court to declare who the parent or child is. Part of this means that the court may order that the involved people take a DNA test to find out who the parent or child belongs to. 📷: Unsplash

Hackers Exploit WebAPK to Deceive Android Users into Installing Malicious Apps.

By THN. Threat actors are taking advantage of Android's WebAPK technology to trick unsuspecting users into installing malicious web apps on Android phones that are designed to capture sensitive personal information. "The attack began with victims receiving SMS messages suggesting the need to update a mobile banking application," researchers from CSIRT KNF said in an analysis released last week. "The link contained in the message led to a site that used WebAPK technology to install a malicious application on the victim's device." The application impersonates PKO Bank Polski, a multinational banking and financial services company headquartered in Warsaw. IF I PAY FOR A CONCERT AND THE MUSICIAN DOES NOT SHOW UP, WHO DO I SUE ?.

By BarefootLawyers. Miti is a very big fan of JJJ a popular musician from South Africa. When he heard that JJJ was coming to Uganda, he bought an early bird ticket two months before the concert. On the day of the concert, Miti prepared and went to the concert venue very early. On reaching there, they were told that due to factors beyond their control, JJJ could not be coming and so the concert was canceled. Miti is very angry and wants to know who he can sue. WHAT DOES THE LAW SAY? When you buy a ticket for a concert, you would have entered into an agreement (contract) with a company that is going to bring that musician. Therefore, if the company that was supposed to bring the musician fails to do so, then that company would have breached the terms of the contract. Therefore, Miti can sue the company that was supposed to bring JJJ because the company breached the terms of the contract. In such cases, however, the company would have to refund you the cost of the ticket, or p

Did you know that today is Nelson Mandela Day ?.

By BarefootLawyers. On the 18th of July every year, the world celebrates Nelson Mandela’s values and dedication to serving humanity. Today we celebrate the power of individuals to make a difference and create positive change in their communities, regardless of their background or circumstances. Nelson Mandela fought against the apartheid system, which separated people based on their skin colour and race in South Africa. Mandela believed in equality and wanted everyone to be treated equally, regardless of race. He spent 27 years in prison for his beliefs but never gave up. When he was finally released, he became South Africa's first black president and worked to bring people together. Mandela showed the world that forgiveness and unity are powerful forces.  He taught us to stand up for what is right and treat each other respectfully and kindly. Today, remember that we all have a part in fighting injustices and discrimination within our societies. Photo by Gregory Fullard
