When Nankya’s man left Masaka for Kampala, she knew he would make it. She was aware of the many warnings that her friends had made to her concerning the lies people sometimes tell, but she knew that her man was different. She had no reason to doubt him when he called her to join her in the big city and told her of the fortune God had blessed her with.
On Saturday while they were taking a stroll through Kampala, her man kept showing her some of his properties including Mapeera and Workers House. She also showed him some gardens around City Square that had grass only and said it was his as well. He decided to gift it to her as a Valentines gift which excited Nankya.
She has always liked to be handy and decided she would wake up the next morning and dig this garden at City Square. She thought to herself, “how can we waste such good land and not plant some matooke for sell?” Indeed, the next morning she was up very early at 5am digging at city square. She did not manage to go long before she was arrested by some men putting on yellow uniform with the words KCCA on them. What did she do wrong?
WHAT DOES THE LAW SAY?
Well firstly, one cannot sell what they do not own lawfully. It is unfortunate that the boyfriend was lying to her because City Squares are public property (belonging to the government on behalf of the general public) and cannot be owned by private individuals like her man.
Even if someone had sold it to him, that would not be a transaction allowed under the law. The city authorities have the responsibility of taking care of such public property so that anyone can use them as long as they do not do anything that offends other users. Digging city square to put your matooke is not allowed both because it is public property that cannot be owned by private individuals and also because it damages the garden making it harder for other members of the public to comfortably use it.
