Joseph and his sisters lost their family land to a greedy relative when their parents passed away in a road accident. At the time they were 12 and 11 years old so they could not do anything about the court case their relatives took to court and stole their land. Now that Joseph is 21 and he has joined law school. He wants to tackle this case. Can he sue his relatives again?
WHAT DOES THE LAW SAY?
By law, when court makes a decision and you disagree with it or you are not satisfied with how the court came to that decision, you have a right to take your case to a higher court. This is called an appeal.
However, this right has a time limit. If it is a criminal case, then you have 14 days from when the court passed its decision. If it is a civil case (about a disagreement between 2 sides like that of Joseph and his relatives) then you have 30 days to make your appeal to the higher court.
However if you have a good reason why you were unable to do it within that time, you can ask court to give you more time and court may consider it if it is in the interest of justice.
