Kambukha collected ‘contribution’ from all his family members so that he could hire Makubuya as his lawyer. There were rumors that Makubuya had never lost a case, so Kambukha knew this was the ‘man he wanted fighting for him’. The problem is Makubuya is always busy.
It has been 7 months since he picked calls or even joined Kambukha in court. Kambukha has been warned that things are not looking good for him, and he may even end up in prison. Kambukha wanted to switch to another lawyer who can ‘save’ him but he is worried if the court will not just chase him away and order him to just do everything himself.
WHAT DOES THE LAW SAY?
By law, anyone who has a case before a court is allowed to either represent themselves or bring a legal representative (called a lawyer) to represent them and argue their case. This does not mean that you only get one chance to choose which lawyer represents you.
If the case is still going on and the court has not made a final decision about your case, you are free to ‘drop’ and ‘pick’ any other lawyer who gives you the best chance of winning the case before court.
You have to only have to inform the court about this change though so that they can know that the new lawyer that is standing before the court is doing so on your behalf. This will allow the court to give this new lawyer a copy of the court file so that they can be able to defend your case.
Remember, you still have to pay your old lawyer for the work that they did and if it is you who paid extra for work that the lawyer did not do, then you can ask for a refund.
