Ebang is a security guard at one of the biggest buildings in Kampala. His boss told him to make sure that before anyone enters, they register in their visitors’ book. Ebang has noticed that once the visitors’ books are used up, his boss tells him to keep them in the store and never follows up. A few people have been asking Ebang to sell to them these books so that they can get phone numbers to advertise their businesses.
Can Ebang sell these books since the office does not need them anymore?
WHAT DOES THE LAW SAY?
Where a person shares their personal information with an organisation or with someone, it is on the understanding that it is for a specific purpose. In this case it is to know who has entered the building and who they have come to see. If you sell a person’s information to someone else to advertise with or do something else with that was not the reason that this information was requested or given then this is illegal. The punishment for this is a fine of UGX 4,800,000 or imprisonment for a period of up to 10 years.
So if Ebang sells the registration books, he can be sued or even convicted of selling personal information even if the building owner does not ask for the books.
