CAN YOU SUE SOMEONE FOR PULLING YOU ON THE STREET ?.

Prossy’s friends told her about ‘Gazaland’ and the best ‘cheap’ earrings for her university welcome dinner. When she reached Gazaland, many women with wigs started calling out to her, saying, “sister, jjangu ogule kubuviiri” (Sister, come and buy some hair). And even when she refused, they told her she had smelly brown hair, and they started pulling her towards a saloon. When she pulled away, they hit her with an old smelly wig and told her to continue looking ‘ugly’.  Prossy is a first-year law student, and she has heard all about suing people. She wants to know if she can sue the salon hair woman who pulled and abused her.

 

WHAT DOES THE LAW SAY?

By law, every person is entitled to privacy from someone entering into their personal space. However, for this to become either a crime or a reason for you to sue them in court, this touching must include things that the law considers illegal, such as causing you harm, or injury. An injury is any harm caused to a person by the acts of another.

The law says that any person who intentionally or recklessly uses physical force against another person commits an offence known as assault. For that person to be answerable for this assault, they should have intentionally or recklessly applied force to hit or touch you without your permission and this causes you actual harm to your body.

If Prossy got injured by the saloon women who pulled her towards the saloon and threw a wig at her, then she could report them to the police for assaulting her. However, if there were no injuries, then she cannot sue or report them for the assault. If you have been injured by someone who pulled you in a crowded place, it is important to seek legal advice to determine whether you have a case and to protect your legal rights. You will need evidence to support your case, such as medical records, photographs of your injuries, and witness statements.

Lab Student Drowned, Body Missing in Rokoze Lake in Nyadri Sub-county, Maracha District.

Hon Oguzu Lee Denis Drags to Court, Maracha Constituency MP-Elect Uhuru Nelson and Electoral Commission.
