Fatuma has been married 8 years since her parents found her a husband. They have a big house, a huge business, and many cars. Ayra has been dating and getting dumped in those 8 years with nothing to show. Last month her parents sat her down and told her to prepare for a meeting on Sunday. On Sunday, Eridad and his parents showed up, and both their parents announced that they have until the end of the year to get their affairs in order so that they could get married.
Kyoka Ayra has just got a new boyfriend who she thinks she loves and has told her parents that she will not get married to Eridad. Her parents have even threatened to disown her if she does not obey them. If Arya goes through with this marriage with Eridad will the marriage be legal?
WHAT DOES THE LAW SAY?
The law says that every person 18 and over is free to get married. However, the decision of when and to whom to marry must be that person’s choice. In law, this is called consent.
This consent must be voluntarily (freely) given without any force or trickery.
So, if Ayra does not want to get married right now or to Eridad, then she is free not to do so, and if she is forced to marry him by threats, then the marriage between Ayra and Eridad would be unlawful, and she would be free to ask the court to cancel it.
However, if Ayra had agreed to her parents looking for a husband for her and Eridad was also willing to marry her, then this sort of arranged marriage would be a legal marriage because both Ayra and Eridad would have freely agreed to get married.
