LAW; MUST YOU WARN PEOPLE ABOUT YOUR DOGS ?.




Jajja Mbwa has silent, scary-looking dogs. Rumour has it that such dogs can ‘eat a whole person, so no one ever goes near his gate unless he has given them the go-ahead. The new neighbour did not know this, and while putting his TV Antenna on the fence, it fell into Jajja’s compound. Without asking, the neighbour jumped into Jajja Mbwa’s compound, and the silent ‘killers’ jumped on him and started tearing pieces. Luckily, Jajja Mbwa heard the screams and saved him, but some damage had already been done.


The neighbour is angry because he did not see any notice about the dogs being there. Should Jajja Mbwa have notified people about the dogs he keeps?


WHAT DOES THE LAW SAY?


By law, if you believe what you have is a dangerous creature, you have a duty to make sure it does not cause injury to your visitors. This means that when you have people in your home where the dog is and you invite them, you also have a responsibility for their safety.


On the other hand, a person who enters your property but you have not invited is called a trespasser. You do not have a duty to protect this person while they are in your home. This means that they cannot sue you for their injuries.


However, since there are people who are by law allowed onto your property, such as the UMEME and NWSC meter readers, you have to warn them about the dogs to be on the safe side.

Lab Student Drowned, Body Missing in Rokoze Lake in Nyadri Sub-county, Maracha District.

Hon Oguzu Lee Denis Drags to Court, Maracha Constituency MP-Elect Uhuru Nelson and Electoral Commission.
