Nwoya never trusted that “Total Results Church” or their pastor when they came to his village. From their name, to how the pastor dressed and how he kept people’s wives till late at church, everything was fishy. In December, Nwoya’s wife Fille joined “Total Results Church” and immediately started the same ‘bad manners’. She would stay at church until 11pm and on Sunday, she would leave home and 5am and come back on Monday morning.
At the start of December, the church declared a ‘total breakthrough fast’ for 80 days. Fille did not even eat the Christmas meat that she always looked forward to, and even when Nwoya tried to get her to eat something, she called him ‘the tempting satan’ and shifted to the church. Yesterday, Nwoya got the news that his wife and other church members died of starvation.
Nwoya has been crushed by this news and wants to sue that church for killing his wife because they made her ‘fast’ Can Nwoya sue them?
WHAT DOES THE LAW SAY?
According to the law, every person has a right to practice, and be part of a religion or take on a religious belief of their choice. This means a person has a right to join or leave a religious group or to completely discard any religious belief.
This is a personal choice, and you cannot sue another person because they made someone you know join a particular religious group. This is known as the freedom of worship and association.
However, not all groups are legal. According to the law, there is something called unlawful society. An unlawful society is any group of 2 or more people that is formed for or supports certain illegal acts such as the killing, injuring, inciting of violence against people, destroying or damaging property, committing, or inciting violent or intimidating acts, Interfering with administration of the law, disturbing peace and order etc.
If someone forms a church and the activities of that church or religious group cause harm or injure people, then this qualifies as an unlawful society. Even if Nwoya cannot sue the pastor of that church, he can report the pastor to the police because what the pastor did to the church members was a criminal act and he should answer before the courts of law for it.
