Kachapi decided to start his weekend on Wednesday and asked his usual waiter to recommend a very strong drink. He was unsure what he was given but found he could not stand so he decided to go home. Unfortunately, Kachapi ended up at the wrong house. He thought he had forgotten the keys and climbed the fence and that is how the owner of the house got him and took him to the nearest police post, saying that they should arrest him for trespassing in his home. Kachapi has insisted that it was not his fault since he was drunk and did not know what he was doing.
WHAT DOES THE LAW SAY?
The law (the Penal Code) says that you cannot excuse your offense or crime because you are drunk ESPECIALLY if you are the one who made yourself drunk. Whatever you do in a drunken state when you took the alcohol yourself, is your fault.
However, if you unknowingly got tricked into getting drunk or intoxicated, then the law may excuse you for what you may do while in that state.
