Beitu and Someyi have had ‘beef’ since first year at the university. Then about two months ago, Beitu and Someyi exchanged bitter words at a bar and Someyi even told Beitu that her ‘end was near’. It has now been 20 days since Beitu was last seen. When Someyi heard about it, he went straight to his Tiktok and recorded a video telling everyone that ‘that babe Beitu is finished!! And he is the one responsible” He even went on and described the way Beitu may have been killed. After about an hour he came back and made another recording telling his followers that it was a joke, but he would have loved to do it.
Last week, Beitu’s body was found near a rubbish heap and the police has declared it as a murder. Someyi has now heard that the police are looking for him and now he is worried that they took his ‘confession’ seriously.
Can his TikTok confession really get him arrested?
WHAT DOES THE LAW SAY?
When a person admits that he/she is guilty of committing a crime, this is known as a confession under the law. A confession does not only have to be in writing, but it can also be spoken or as an audio or video.
By law, a confession that you make can be used against you in court to prove that you did what you are accused of.
However, for a confession to be used against in court, it must have been made before a magistrate or a police officer of assistant inspector rank and above.
So, a confession that you make on social media may not qualify as a confession in law, but it can still be used evidence against you to show you may have committed the crime.
