Hajara was stopped again for speeding by a traffic officer, and she knew she was in trouble. She had 5 unpaid traffic tickets. So they told her that her car was going to be impounded until she paid off all her tickets. When the traffic man tried to enter the car, she refused to let him in and insisted that they allow her to drive to the police station and they could follow if they wanted, but she did not want a traffic man in the car with her. Immediately her car was taken by a ‘breakdown’ to the station, and she now has to pay for breakdown costs.
WHAT DOES THE LAW SAY?.
By law, a traffic officer has the power to stop you on the road and ask to inspect your driving permit. In some cases, if you are not able to drive, or you disagree with the assessment, you do not accept the traffic ticket, and then the officer can decide that your car must be taken to the police station. This can be done in one of two ways. You can use towing services (‘a breakdown’) or if you are comfortable, you can allow a traffic officer to sit in your car and you drive to the police station.
However, a traffic officer cannot force you to let them into your car. They do not have a right to sit in your car and be driven to the police.
