PRISONERS PERISH IN ACCIDENT ON THE WAY TO ‘WORK’. What is the Legal Lesson❓

https://theinformersdotcom.wordpress.com/2021/12/16/prisoners-perish-in-accident-on-the-way-to-work/

In Lwengo District, two prisoners were killed in a motor accident. What happened, in short, is this: they were 8 prisoners were stuffed into a Wish and they were being taken to work somewhere. The driver decided to overtake a trailer in a corner and lost control and the accident occurred. It turns out one of the two dead prisoners was on remand waiting for his trial.

We have decided to say a few things about the rights of prisoners.

Who is a remanded Prisoner? The law (prisons act) says that if a person is taken to prison but has not been sentenced yet, or is waiting for his/her court trial, then this person is said to be on remand. This person is supposed to be treated as innocent until the trial against them is concluded and they are found guilty and convicted. Transportation of prisoners There are authorised vehicles that belong to prisons. However, sometimes a non-official vehicle may be used, but it must be able to safely transport the prisoners.

Who is in charge of prisoners? The officer in charge (OC) of the prison is responsible for the prisoners and their safety that means he/she is always answerable if something happens to the prisoners. As we said, there are prison vehicles that transport prisoners and if they cannot be found then there are authorised other vehicles. However, if the person responsible for the prisoners risks their lives by ‘overloading’ them into a vehicle then he becomes liable for causing their injuries or death.

WHAT CAN THE FAMILIES OF THE DECEASED DO?

In law, there is a special type of case if someone causes the death of a family member. It is called “death as a cause of action”. If a person causes the death of your family member who was either the breadwinner or had the potential to be something in future because of their negligence or recklessness, they should compensate the family for this. Therefore any family member of the deceased prisoners can sue the person who is deemed responsible for this unfortunate accident.
