SHOULD YOU BE GIVEN NOTICE WHEN YOUR CONTRACT IS EXPIRING❓



Kimera has been an absolute terror at his workplace. He has often bragged about how he could bring anyone to tears if he wanted. Even his supervisor is uncomfortable dealing with him. Last week, the atmosphere around his workmates has been very cheerful since they heard that some contracts may not be renewed. Upon some ‘careful’ snooping and interrogation of the HR staff, Kimera has found out that his contract is one of those that will not be renewed. He is now on the warpath and intends to sue the company into the ‘stone age’ for not giving him notice that he will have no new contract. 


SHOULD YOUR EMPLOYER NOTIFY YOU THAT YOU WILL NOT HAVE A NEW CONTRACT?

No, the law does not ‘demand that your employer give you a notice that your contract will not be renewed. This is because your contract already states when the contract will expire. Some contracts also have a clause that says the employer will inform you when your contract is about to expire whether it will be renewed or not. If it has that term, then your employer must inform you.


However, your employer still has to let you know that you should not show up again from a certain date onwards whether orally or in writing, so you do not keep working after that date. Much as the law doesn't necessarily require that your employees are given notice (unless stated in the contract) shortly before their contracts are ending, wouldn't it be a bit more courteous to give them a heads-up?  This is helpful to make sure that you do not show up and keep working when the contract expired. If this happens the law will take it that your contract has been renewed whether your employer has informed you or not.


However, if your contract is going to be renewed, your employer must inform you so that you choose whether to accept the contract extension or not.
