Carol likes free things. Her friends told her to go out with them to check out this new club, so she just went ‘fwaah’ with no money, no ATM, nothing! After a few drinks on them, she went to the bathroom and came back to find the table with a fresh bucket of beers open and her friends were gone.
The waiter told her to pay, and Carol started panicking. A guy who had been giving her ‘funny eyes’ the whole night came to her rescue, cleared the bill, and together, they cleared the beers. Then he asked her to go to his place for the night. As they were leaving, Afande John who had watched the whole thing arrested them, ‘mbu’ for prostitution. Was this prostitution?
WHAT DOES THE LAW SAY?
By law, you are not allowed to have sex for gifts, benefits or to gain something. That is called prostitution and it is punishable by imprisonment for up to 7 years. Even the person who asks for sex in exchange for something is committing an offence.
Drinks at the bar, may seem like a small thing, but it is a benefit so if Carol was taking drinks with the plan that she would pay for them with sex, then this would be prostitution and if the guy who paid for the drinks expected to be paid in sex and Carol allowed, then this would also be prostitution.
However, if Carol and her ‘new’ catch just enjoyed each other’s company and decided to go to his place without it being about her repaying him for helping her pay for her beers, this is not prostitution and this is not against the law.
